ELLIOTTICIAN SOFTWARE AND SERVICES TERMS OF USE AGREEMENT:

THE SOFTWARE AND SERVICES THAT YOU RECEIVE FROM ELLIOTTICIAN ARE SUBJECT TO THE FOLLOWING TOU (TERMS OF USE). THE MOST CURRENT VERSION OF THE TOU CAN BE FOUND AT ANY TIME WITHIN THE MOST RECENT VERSION OF REFINED ELLIOTT TRADER HELP MENU. ELLIOTTICIAN SPECIFICALLY RESERVES THE RIGHT TO MODIFY THE TOU WITHOUT NOTICE.

THE SERVICES PROVIDED TO YOU BY ELLIOTTICIAN INCLUDE TRADING AND PATTERN RECOGNITION SOFTWARE, COMMUNITY FORUMS, PRODUCT INFORMATION (COLLECTIVELY "SERVICES"). THESE SERVICES, INCLUDING IMPROVEMENTS, UPDATES, NEW FEATURES ARE SUBJECT TO THIS TOU. UNLESS YOU HAVE OBTAINED PRIOR WRITTEN PERMISSION FROM ELLIOTTICIAN, THE SERVICES ARE ONLY FOR YOUR PERSONAL AND PRIVATE NON-COMMERCIAL USE.

YOU MAY NOT LICENSE, DISPLAY, DISTRIBUTE, TRANSMIT, PERFORM, PUBLISH, SELL ANY INFORMATION, SOFTWARE, PRODUCTS OR SERVICES OBTAINED FROM THESE SERVICES. ALL SOFTWARE THAT ELLIOTTICIAN PROVIDE FOR DOWNLOAD FROM THE SERVICES ("SOFTWARE") IS OWNED AND COPYRIGHT BY ELLIOTTICIAN. ANY REDISTRIBUTION OR REPRODUCTION OF THE SOFTWARE IS EXPRESSLY PROHIBITED BY LAW. THE SOFTWARE IS AVAILABLE FOR USE BY END USERS ONLY. VIOLATORS WILL BE PROSECUTED TO THE MAXIMUM EXTEND OF THE LAW.

ELLIOTTICIAN DISCLAIMS ALL WARRANTIES AND CONDITIONS IN REGARD TO THE SOFTWARE, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND ACCURACY OF THE RESULTS OR OUTPUT. ELLIOTTICIAN SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM LOS OF USE, DATA OR PROFITS ARISING OUT OF OR IN CONNECTION WITH THE USE OF PERFORMANCE OF SOFTWARE, DOCUMENTS OR OTHER INFORMATION AVAILABLE FROM SERVICES.

IT IS A CONDITION OF YOUR USE OF THESE SERVICES THAT YOU WILL NOT USE THEM FOR ANY PURPOSE THAT IS UNLAWFUL OR PROHIBITED. YOU MAY NOT USE THE SERVICES IN ANY MANNER THAT COULD INTERFERE WITH ANY PARTY’S USE AND ENJOYMENT OF THE SERVICES. YOU MAY NOT ATTEMPT TO GAIN UNAUTHORIZED ACCESS TO ACCOUNTS, COMPUTER SYSTEMS, NETWORKS OR ANY ELLIOTTICIAN SERVER THROUGH HACKING, PASSWORD OR EMAIL MINING OR BY ANY OTHER MEANS. YOU MAY NOT OBTAIN OR ATTEMPT TO OBTAIN ANY INFORMATION THROUGH ANY MEANS NOT INTENTIONALLY MADE AVAILABLE THROUGH THE SERVICES. THE SERVICES MAY CONTAIN FORUM SERVICES, CHAT AREAS, AND OTHER MESSAGE OR COMMUNICATION FACILITIES DESIGNED TO CONNECT YOU WITH OTHERS. YOU AGREE TO USE THESE COMMUNICATION SERVICES ONLY TO SEND AND RECEIVE MESSAGES THAT RELATE TO THE PARTICULAR COMMUNICATION SERVICE.

YOU AGREE THAT WHEN USING THE COMMUNICATION SERVICES, YOU WILL NOT: 1) USE THE SERVICES IN CONNECTION WITH JUNK EMAIL, SPAMMING OR ANY DUPLICATIVE OR UNSOLICITED MESSAGES, COMMERCIAL OR OTHERWISE. 2) ABUSE, HARASS, DEFAME, THREATEN, STALK OR VIOLATE THE LEGAL RIGHTS OF OTHERS. 3) POST, PUBLISH, UPLOAD OR DISTRIBUTE ANY INAPPROPRIATE, DEFAMATORY, OBSCENE OR UNLAWFUL MATERIAL OR INFORMATION. 4) OBTAIN, DOWNLOAD OR COPY, PROVIDE TO ANY PERSON ANY DIRECTORY OF USERS OF THE SERVICES OR OTHER USER. 5) USAGE OF ANY INFORMATION OR IMAGES WHICH ARE MADE AVAILABLE THROUGH THE SERVICES THAT INFRINGES COPYRIGHT, PATENT, OR OTHER PROPRIETARY RIGHT OF ANY PARTY. 6) ADVERTISE ANY GOODS OR SERVICES FOR ANY PURPOSE, INCLUDING BUSINESS. 7) INHIBIT OR RESTRICT ANY OTHER USER FROM USING THE COMMUNICATION SERVICES. 8) HARVEST OR COLLECT ANY INFORMATION ABOUT OTHERS, INCLUDING E-MAIL ADDRESSES. 9) VIOLATE ANY APPLICABLE LAWS OR REGULATIONS.

ELLIOTTICIAN RESERVES THE RIGHT TO REVIEW INFORMATION UPLOADED TO THE COMMUNICATION SERVICES AND TO DELETE ANY POSTING AT ANY TIME AT ITS SOLE DISCRETION. ELLIOTTICIAN ALSO RESERVES THE RIGHT TO TERMINATE YOUR ACCESS TO THE SOFTWARE AND COMMUNICATION SERVICES AT ANY TIME, WITHOUT NOTICE, FOR ANY REASON WHATSOEVER.

ELLIOTTICIAN DOES NOT CONTROL OR ENDORSE THE CONTENT FOUND IN ANY OF ITS COMMUNICATION SERVICES AND SPECIFICALLY DISCLAIMS ANY LIABILITY AND ANY ACTIONS RESULTING FROM YOUR PARTICIPATION IN ANY COMMUNICATION SERVICES. MODERATORS ARE NOT AUTHORIZED ELLIOTTICIAN SPOKESPERSONS, AND THEIR VIEWS DO NOT NECESSARILY REFLECT THOSE OF ELLIOTTICIAN.
